PUBLIC ANNOUNCEMENT - SWIMMING POOL MANAGEMENT AGREEMENT

Sealed proposals will be received by the Board of Township Trustees of Orange Township, Delaware County, Ohio (“Board”) until 1:30 p.m., local time, on February 28, 2019, from qualified firms, corporations or individuals (hereinafter “Proposer” or “Proposers,” as appropriate) seeking to operate and manage the Board’s swimming pool and concession stand facility at it’s North Orange Park, located at 7560 Gooding Boulevard, Delaware, Ohio 43015, and at that time and place publicly opened and read aloud.  A pre-proposal conference shall be held at 1:30 p.m., local time, on February 21, 2019, at the Orange Township Hall, located at 1680 East Orange Road, Lewis Center, Ohio 43035.

The Board is soliciting bid prices for basic services and unit prices for limited additional services as stated in it’s proposed Swimming Pool Management Agreement and alternate bid prices for the provision of additional Lifeguards, Concession Employees and front desk workers on an hourly unit cost basis (“Alternate #1) and on a lump sum basis (“Alternate #2), respectively.  Each Proposer must submit bid prices for the basic services, unit prices for the limited additional services and prices for each of these alternates.  In the sole discretion of the Board, the award of the contract may be made on the basis of the bid price for the basic services stated in the proposed Swimming Pool Management Agreement, the sum of that bid price plus the Alternate #1 Overall Cost for Bidding Purposes, or the sum of that bid price plus the Alternate #2 Lump Sum Price.  The Proposal Form and the proposed Swimming Pool Management Agreement, Alternate #1 and Alternate #2, all included in the Proposal Manual, must be completed and submitted by the Proposer, together with all other required documents.  The successful Proposer will operate and manage the original pool and facilities, the expansion pool and facilities added in 2009 and the concession stand during the 2019 Pool/Concession Year, as defined in the final agreement.  

The Proposal Manual, containing the entire terms and conditions of this contract, including but not limited to the Proposal Instructions, Proposal Form and accompanying Swimming Pool Management Agreement, Alternate #1 form and Alternate #2 form, may be obtained by contacting the Township Fiscal Office, located at 1680 E. Orange Road, Lewis Center, Ohio 43035 (Telephone: 740-548-5430) until the time set for the opening of proposals.  The Board will not be responsible for any internal or external delivery delays which may cause a proposal to arrive beyond the deadline.  

Proposals must be submitted using the Proposal Form and accompanying Swimming Pool Management Agreement form, Alternate #1 form and Alternate #2 form mentioned, and shall be enclosed in sealed opaque envelopes addressed to the Board, c/o Wesley W. Mayer, Orange Township Fiscal Officer, marked:  "Proposal for Swimming Pool Management Agreement."  Proposers must submit an original plus five (5) copies of their proposal.  By submitting a proposal, the submitting Proposer agrees that its proposal will be valid and open for acceptance until thirty (30) calendar days after the opening date although not accepted or rejected.  Each proposal must contain the full name of the party or parties submitting the proposal and all persons interested therein.  Each Proposer must submit evidence of their experience in operating and managing facilities of similar size and complexity.  The Board intends and requires that services be undertaken by the successful Proposer no later than March 11, 2019.  Time is of the essence to this contract.  The successful Proposer shall be an Equal Opportunity Employer.  

A Contract Performance Security in the form of a contract performance bond or an irrevocable Letter of Credit, either conditioned to ensure the faithful performance of all terms of the contract and in the full amount of the price proposed, shall be required from the successful Proposer, may be submitted with the proposal and shall remain in force throughout the term of the contract.  All Contract Performance Security shall be in the name of the Board and be furnished within ten (10) days from the date of the award.  Contract Performance Security furnished in bond form shall be issued by a Surety Company licensed in the State of Ohio to provide said surety.  

To be eligible for consideration of award, a Proposer must not have a disqualifying unresolved finding for recovery, as provided in R.C. Section 9.24.  Prior to the Board’s entering into the contract, the successful Proposer must execute a Certification/Affidavit in Compliance with R.C. Section 3517.13 which will be provided by the Board and a provision will be included in the contract by which that Proposer will further certify that the persons responsible for it’s organization are in compliance with the contractor contribution limitations set forth in R.C. 3517.13(I) and R.C. 3517.13(J).

The Board reserves the right to select, in it’s sole discretion, the proposal deemed most (responsive & responsible), to negotiate modifications to any proposal, to waive any informalities or irregularities that do not affect the substance of the requirements of this Public Announcement or the Proposal Manual, and to reject any and/or all proposals received or any portion of any and/or all proposals received.  Neither this solicitation nor the submission of a reply to this Public Announcement shall commit the Board to award a contract, to pay any costs incurred in preparation of a response to this request, or to procure or contract any services.  The Board reserves the right to modify or cancel, in whole or in part, the scope of the contract reflected in this solicitation and the Proposal Manual.
